Terms of Service

These Terms govern your use of stnd-os (the "Service") provided by STND ("we," "us"). By creating an account or using the Service, you agree to these Terms.

1. Beta status

The Service is currently in closed beta. This means:

  • Features may change, break, or disappear without notice
  • We do not guarantee uptime, data persistence, or availability
  • The Service is provided "as is" without warranties of any kind
  • We may suspend or terminate the beta at any time
  • During the beta, the Service is free of charge; this may change at general release with notice

You acknowledge you are using pre-release software at your own risk.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. You assert both, and your agreement to these Terms and the Privacy Policy, when you create an account. You must provide accurate information and keep your account secure.

3. Your account

You are responsible for:

  • All activity under your account
  • Keeping your password and credentials secure
  • Notifying us promptly of any unauthorized access (privacy@stnd.store)

You connect a third-party Instagram account through the Service via Zernio. You confirm that you have authority to do so and that your use of Instagram complies with Instagram's own terms.

Automated direct-message replies. The Service can respond to direct messages sent to your connected Instagram account on your behalf. If you use this capability, messages the assistant sends are sent as you and are your responsibility: you must review its behavior, you can take over any conversation at any time (a human reply pauses the assistant for that conversation), and you remain responsible for compliance with Instagram's terms and applicable messaging laws. We may suspend automated messaging that generates abuse reports or violates §4.

4. Acceptable use

You may NOT:

  • Use the Service for any illegal purpose
  • Generate or distribute content that is defamatory, harassing, fraudulent, hateful, sexually explicit, infringing, or otherwise unlawful
  • Impersonate any person or entity
  • Reverse-engineer, scrape, or attempt to circumvent rate limits or access controls
  • Use the Service to spam, abuse, or harm other Instagram users
  • Use the Service to violate Instagram's Terms of Service or applicable laws
  • Share your account or allow others to use it
  • Resell, white-label, or commercially distribute the Service without our written agreement

We reserve the right to suspend or terminate accounts that violate these rules.

5. Your content and IP

You own your content. This includes:

  • The text you write (brand guidelines, conversation messages, edits to generated content)
  • The Instagram content you produce
  • Anything you bring to the Service

By using the Service, you grant us a limited license to process your content to provide the Service (e.g., sending your conversation messages to AI providers to generate responses). This license terminates when you delete the relevant content or your account.

We own the Service. The Service's software, design, branding, and underlying platform are our intellectual property. The Service is licensed to you, not sold.

AI-generated content. Content generated by the Service's AI features (scripts, ideas, analyses) is provided to you under a permissive license: you may use it commercially, modify it, and publish it on any platform. We make no claim to ownership of AI-generated outputs in your account.

You should be aware that AI-generated content:

  • May resemble outputs generated for other users (we mitigate this through per-user voice grounding, but cannot guarantee uniqueness)
  • May contain inaccuracies, fabrications, or stylistic issues
  • Should be reviewed by you before public posting

6. Third-party services

The Service integrates with third-party services (Instagram, Anthropic, Google, Zernio, and others — see Privacy Policy [blocked]). Your use of those services is governed by their respective terms. We are not responsible for third-party service availability, data handling, or content.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

We do not warrant:

  • That the Service will be uninterrupted, error-free, or secure
  • That AI-generated content will be accurate, appropriate, or successful
  • That use of the Service will grow your Instagram following, engagement, or revenue
  • That data sourced from third-party services (Instagram, providers) will be timely or complete

8. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or US$100, whichever is greater. Since the closed beta is free, our liability cap during the beta is US$100.

We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits, lost data, or business interruption.

Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold us harmless against claims arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party rights (including content you generate or publish using the Service).

10. Termination

You may close your account anytime. We may suspend or terminate your account for violation of these Terms, fraudulent activity, abuse, or for any reason during the closed beta. On termination, your access to the Service ends; your data is handled per our Privacy Policy [blocked].

11. Changes to the Service

We may modify, suspend, or discontinue any part of the Service. We will provide reasonable notice for material changes affecting paying users (none during the free beta).

12. Changes to these Terms

We may update these Terms. Material changes will be communicated by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes

A specific governing law and dispute forum will be designated when STND incorporates and announced per §12 (Changes to these Terms). Until then, disputes will be handled in good faith through direct contact (§14); nothing in these Terms limits mandatory protections you have under the law of your place of residence.
